From Ethics To Deontology: The Genesis Of Binding-rules

In an ethical dispute a personal opinion or an argument about an ethical question gradually becomes a “proposal of a binding rule”, or even an intitiation for legislative procedures. The rationalae of this process is discussed in this paper.
The author refers to the first article of Turkish Civil Code as a guide in this respect.
The said article gives any court a restriced authority to set a rule about the case at hand. But this power is in action only in the condition of absence of any legal or moral rule in this matter.
This may be an example for setting rules in the ethical committees or in other expert agencies.
The change of continuation of the newly settled rule would be dependent upon its acceptance by public opinion or by a court whereby becoming a case-law.Turkiye Klinikleri J Med Ethics 1994,2:1-2
