Physician Who Is Responsible For Protecting Patient’s Life Should Be Made Oblidged For Denouncing His Patient, Too

aAdli Tıp AD, bDeontoloji ve Tıp Tarihi AD, Osmangazi Üniversitesi Tıp Fakültesi, ESKİŞEHİR The 280th article of the new penal code numbered 5237, which will be in effect in June 2005, which was set instead of 530th article of the current code, brought the decree “In the case a health staff who witnesses an indication of a crime doesn’t denounce it to the judicial authorities, will be sentenced to one-year imprisonment.”
The 530th article of Turkish criminal code brought denouncing obligation for medical personnel in the presence of a crime, exempted them if the patient were exposed to legal proceedings. It’s suggested that People who violate the law be fined lightly.
Medical personnel should attempt to find new solutions, which serve justice, for reformation of the 280th article of the new penal code numbered 5237, which will be in effect in April 2005, which contradicts with the national and international regulations and is a backward step, without violating individual secrecy right.Keywords: Resposibility of physicianTurkiye Klinikleri J Med Ethics 2005, 13:187-190
