However, patients' rights are being violated thousands of times everyday in our country. More than these patient rights' violations, the essential point is the lack of mechanisms to claim those rights and to complaint about the practices. In our country, patients and their relatives are ignorant, powerless and unprotected against physicians and health organizations, and they typically accept what they have experienced with patience. Some of the reasons are supposed to be underdeveloped nature of patient right conscious and patient organizations, and besides insufficiencies in having proper ethical and legal regulations on patient rights. By the means of the "Regulation on Patients Rights", which was prepared by the Ministry of Health in 1998, the insufficiencies on this issue have been compensated to some extend. Another legal draft named "Responsibilities Due to Malpractice in Medical Services" has been prepared and in the process of becoming a law. In this article, this draft on one hand and the general conditions of the country on the other are being criticized. Keywords: Medical Malpractice, Patient's rights, Medical EthicsTurkiye Klinikleri J Med Ethics-Hukuku-Tarihi 2003, 11:140-147
